This Refund & Cancellation Policy governs monthly memberships, single session drop-in registrations, tournament fees, and other program fees charged by Atlantis Chess Club. By enrolling in Atlantis Chess Club and completing payment, parents and guardians acknowledge and agree to this policy.
Atlantis Chess Club monthly membership is billed for four scheduled program sessions per billing cycle. Membership fees are charged on a monthly basis, whether or not the student attends all scheduled sessions within the billing cycle.
Monthly membership automatically renews on a recurring monthly basis unless cancelled in accordance with this Policy. By purchasing a monthly membership, the parent or guardian authorizes Atlantis Chess Club and its third-party payment processor to charge the payment method provided for the applicable monthly membership fee until the membership is cancelled.
Atlantis Chess Club will disclose the automatic renewal terms during the registration or checkout process, including the billing amount, billing frequency, and cancellation method. Atlantis Chess Club will provide any renewal notices required by applicable law and may also send courtesy billing reminders to the email address or phone number on file.
It is the parent’s or guardian’s responsibility to keep contact information current and to cancel before the applicable cancellation deadline if they do not wish to continue the membership.
Missed sessions are non-refundable. A missed session does not qualify for a credit, refund, or make-up session unless Atlantis Chess Club cancels or reschedules the session as described in Section 7 of this policy.
A parent or guardian may cancel a monthly membership by submitting a written cancellation request by email to members@atlantischessclub.com, by using any cancellation method made available through Atlantis Chess Club’s registration or payment platform, or by any other cancellation method Atlantis Chess Club expressly provides in writing.
Cancellation requests should be received at least fourteen (14) days before the next billing date to avoid the next billing cycle charge. Cancellation requests received fewer than fourteen (14) days before the next billing date may not take effect until the following billing cycle, and the upcoming billing cycle charge may be processed.
Atlantis Chess Club will not require a parent or guardian to cancel in a manner that is materially more burdensome than the method used to enroll, to the extent required by applicable law.
Upon receipt of a written cancellation request, Atlantis Chess Club will confirm receipt and the effective date of cancellation by email within 3–5 business days. A cancellation will be processed based on the date Atlantis Chess Club receives the written cancellation request, once confirmed in writing by Atlantis Chess Club.
If a parent or guardian does not receive a written confirmation within 5 business days of submitting a cancellation request, they should follow up by emailing members@atlantischessclub.com or texting 786-436-1434 to confirm the request was received.
No further charges will be processed after the confirmed cancellation effective date, subject to any amounts due for the current or upcoming billing cycle per the 14-day notice requirement described in Section 4.
Membership fees are not prorated upon cancellation. If a cancellation request is received and confirmed after a billing cycle has already been charged, the membership will remain active through the end of that paid billing cycle. No partial or prorated refunds are issued for unused sessions remaining within a paid billing cycle, except where Atlantis Chess Club cancels sessions as described in Section 7.
If Atlantis Chess Club cancels or reschedules a scheduled session, affected families will be notified as promptly as practicable. Atlantis Chess Club will provide a reasonable remedy under the circumstances, which may include a rescheduled session, a make-up opportunity, a credit toward a future billing cycle, or a refund where Atlantis Chess Club determines that a rescheduled session or credit is not reasonably available.
If the Port St. Lucie Community Center, the Havert L. Fenn Center, or any hosting facility is closed for any reason, Atlantis Chess Club programs at that facility will also be closed for that session and will be treated as a program cancellation for purposes of this section.
Single Session Drop-In registration fees, tournament entry fees, and special event fees may be subject to separate refund and cancellation terms communicated at the time of registration for the applicable session, tournament, or event.
In the absence of separately communicated refund terms at the time of registration, Single Session Drop-In fees, tournament entry fees, and special event fees are non-refundable once paid, except where Atlantis Chess Club cancels or reschedules the applicable session, tournament, or event.
If Atlantis Chess Club removes or dismisses a student from the program for behavioral, safety, or conduct-related reasons as described in the Atlantis Chess Club Terms & Conditions, Atlantis Chess Club will, in its sole and reasonable discretion, determine whether any prorated refund, credit, or other remedy is appropriate under the circumstances. No refund is automatically owed upon a student’s dismissal by Atlantis Chess Club.
If a payment fails, is declined, is reversed, or is subject to a chargeback, Atlantis Chess Club may suspend or cancel the student’s registration or participation until the payment issue is resolved. Parents and guardians agree to contact Atlantis Chess Club first to resolve billing concerns before initiating a chargeback, unless prohibited by applicable law.
Atlantis Chess Club reserves the right to recover unpaid fees, chargeback fees, processing costs, and other amounts owed to the extent permitted by law.
Nothing in this Policy limits any refund, cancellation, or consumer protection right that cannot legally be waived under applicable law. If applicable law requires a refund, cancellation right, notice, or remedy that is broader than this Policy, Atlantis Chess Club will comply with the applicable legal requirement.
Atlantis Chess Club may update this Refund & Cancellation Policy as needed to reflect changes in program operations, applicable law, or billing practices. Updates will be posted on the Atlantis Chess Club website with a revised effective date. The version in effect at the time of the applicable billing cycle or transaction governs.
